The Trump DOJ just indicted a man for a beach photo. No, seriously. A fucking beach photo.

The Department of Justice indicted former FBI Director James Comey for the second time on Tuesday, April 28, 2026. The charges stem from an Instagram post Comey shared last May showing seashells arranged on a beach to read “86 47.” CBS News confirmed the indictment was filed in the Eastern District of North Carolina.
The post was up for a few hours. He took it down, and he apologized. That’s the whole goddamn story, and if this country had two functioning brain cells left to rub together, it would’ve ended there.
Instead, we’ve got a federal grand jury, a second indictment, and prosecutors with law degrees and government salaries who have apparently decided that the gravest threat to the American republic is a retired FBI director who photographed some fucking seashells someone else arranged on a beach.

Here’s what actually happened. James Comey went for a walk on a beach, came across shells arranged in the sand by someone else, took a photo, and posted it. A few hours later, people started losing their minds, and he wrote -- and CBS News quoted this directly -- “I didn’t realize some folks associate those numbers with violence. It never occurred to me, but I oppose violence of any kind, so I took the post down.” That’s the full extent of the federal crime. A retired man photographed somebody else’s sand art, got yelled at about it on the internet, and deleted it. The Justice Department of the United States of America would like him to answer for that in court.
The Secret Service dispatched agents trained in threat assessment and protective intelligence to conduct a multi-hour interview with a retired federal official about whether he had used wet sand and calcium carbonate to communicate a presidential assassination order.
Kristi Noem, who was at that point still technically the Secretary of Homeland Security, went on record declaring that Comey had “just called for the assassination” of the president. Not allegedly. Not possibly. “Just called for.” Finished. Done. Seashells equal murder.
The woman responsible for the safety of three hundred and forty million Americans looked at a beach photograph and announced a federal assassination conspiracy. Said the Secret Service would “respond appropriately.”
Their appropriate response was to interview a man about sand art for several hours and apparently find nothing, since it took another year to scrape together an indictment.
Now here’s where it really goes sideways. This is the SECOND indictment. The first one, filed in September 2024, charged Comey with lying to Congress and obstruction. That case got thrown out in November because the prosecutor who secured it had been unlawfully appointed to her position. A procedural flaw so basic you’d fail a first-year law school exam for missing it. The judge overseeing the case never even got around to ruling on Comey’s argument that the prosecution was vindictive and driven by Trump’s “personal spite,” because the whole thing collapsed on its own before she had to.
So, when your first attempt to imprison your political enemy falls apart because your own prosecutor wasn’t legally authorized to prosecute anyone, the obvious move is to go back to the grand jury well and build a new case out of whatever’s left lying around. The obstruction charges couldn’t finish the job, so now the seashells are going to do it.
What you’d have to believe for this prosecution to make sense is that James Comey, a man who spent decades inside federal law enforcement and knows precisely how surveillance works, decided that the smartest way to order a presidential assassination was to post it on Instagram in shell form on a public account, then delete it a few hours later and write a public apology.
That’s the criminal mastermind the Justice Department is hunting. A guy who encoded a murder conspiracy in beach debris, lost his nerve, apologized, and deleted the evidence in real time on a platform with millions of users.
Now hold that image in your head while I remind you that Trump spent years on Tooth Social and in front of rally crowds calling his political opponents vermin, suggesting the military might need to be deployed against American citizens, and sharing imagery of opponents behind bars. “Lock her up” wasn’t a policy proposal. It was a stadium chant his campaign actively cultivated, and nobody in this administration saw fit to convene a grand jury about any of it.

Trump said out loud, on Truth Social, that Bondi needed to stop delaying and take action against Comey specifically. That’s in the public record. He named him by name. Weeks later, there’s a new indictment. Comey’s lawyers called it vindictive prosecution driven by personal spite in the first case, and the judge never got to rule on it before the whole thing imploded. Maybe the next judge will.
Or maybe we just keep watching a president operate the Justice Department like a personal collections agency for old grudges, dressing up score-settling in grand jury paperwork and calling it accountability.
